Privacy Policy

This Privacy Policy explains how INSTATV TECHNOLOGIES LIMITED LIABILITY COMPANY, trading as InstaTV Technologies (“InstaTV”, “we”, “us”, or “our”), collects, uses, stores, shares, and protects personal data when you use instatv.io, InstaTV Studio, AI media generation, challenge generation, published challenge pages, comments, payments, support, and related services.

We are based in the Republic of Armenia and provide Services globally, except where prohibited by sanctions, export-control, anti-money laundering, payment, or other applicable laws.

We collect personal data you provide directly, data created through your use of the Services, and data received from service providers.

• Account data: name, email address, password/authentication data, account ID, profile details, settings, language, and communication preferences.
• Billing and transaction data: top-up amount, credit balance, usage charges, transaction IDs, receipts, billing country, tax data, payment status, fraud signals, and payment provider references. Full card numbers are processed by payment providers and are not intended to be stored by us.
• User content: prompts, node graphs, uploaded images/videos/files, generated media, dynamic challenge inputs, comments, challenge descriptions, public marketplace submissions, and related metadata.
• Usage and device data: IP address, browser type, device type, operating system, pages visited, actions taken, generation events, error logs, session identifiers, approximate location, and security logs.
• Support data: messages, attachments, troubleshooting data, feedback, and communications with us.
• Cookies and similar technologies: authentication cookies, preferences, security cookies, analytics identifiers, and similar technologies as described in our Cookie Policy.

We use personal data for the following purposes:

• To create and manage accounts, authenticate users, and provide access to the Services.
• To process top-ups, credit usage, direct challenge-generation payments, invoices, refunds, taxes, payment disputes, and fraud prevention.
• To operate AI media generation, process prompts and uploaded media, render outputs, maintain node graphs, and provide challenge recreation workflows.
• To review, moderate, approve, reject, publish, remove, or restrict public challenge pages, comments, and marketplace content.
• To provide customer support, respond to requests, debug errors, and improve reliability and performance.
• To secure the Services, detect abuse, prevent unauthorized access, enforce our Terms, and comply with legal, AML, sanctions, payment, tax, and regulatory obligations.
• To analyze product usage, improve features, develop new tools, and measure service performance.
• To send service notices, transactional emails, security alerts, policy updates, and optional marketing communications where permitted by law.

Where a legal basis is required, we process personal data based on one or more of the following: performance of a contract, your consent, compliance with legal obligations, protection of our legitimate interests, protection of users and the public, and establishment or defense of legal claims.

Examples of legitimate interests include securing the Services, preventing abuse, improving platform reliability, moderating public content, understanding product usage, and protecting InstaTV, creators, users, payment partners, and third parties.

Private Studio generations are visible only to your account unless you choose to share, export, submit, or publish them. Public challenge pages and public challenge outputs may be visible to other users and visitors after you request publication and our team approves them.

We may process prompts, uploaded media, node graphs, generated outputs, and challenge data to provide the requested generation, troubleshoot issues, prevent abuse, apply safety checks, moderate public content, and comply with law. Do not upload sensitive personal data unless necessary and lawful.

We do not sell personal data. We may share personal data with:

• Service providers: cloud hosting, storage, AI model providers, rendering infrastructure, analytics, email delivery, customer support, security, logging, and payment processors.
• Payment and banking partners: to process payments, refunds, disputes, chargebacks, fraud checks, AML/sanctions screening, tax, and compliance requirements.
• Other users and the public: when you publish comments, creator information, challenge descriptions, public challenge pages, or approved public outputs.
• Authorities and legal parties: when required by law, court order, regulatory request, tax obligation, sanctions/AML obligations, or to protect rights, safety, and security.
• Business transfers: in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to appropriate protections.

We are based in Armenia and may use service providers located in other countries. Your data may be transferred to, stored in, or processed in Armenia, the United States, the European Economic Area, Asia, or other locations where we or our providers operate.

Where required, we use appropriate safeguards for international transfers, such as contractual obligations, technical and organizational measures, and transfer mechanisms recognized by applicable law.

We retain personal data for as long as reasonably necessary to provide the Services, maintain your account, operate credits and payments, comply with legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

• Account data is generally retained while your account remains active.
• Private uploaded media and generated outputs are retained while stored in your account unless deleted by you or removed under our policies.
• Public challenges, comments, and approved public outputs may remain available until removed by you where supported, by us, or by applicable legal process.
• Billing, transaction, tax, refund, and compliance records may be retained for up to 7 years or longer if required by law.
• Security logs and technical logs are generally retained for up to 12 months unless needed longer for security, fraud, legal, or dispute reasons.
• Backups may persist for a limited period after deletion before being overwritten.

Depending on your location, you may have rights to access, correct, delete, restrict, object to processing, withdraw consent, request portability, or complain to a data protection authority. Armenian personal data law and other applicable privacy laws may also provide rights to information, rectification, blocking, or deletion of personal data.

The Services are not intended for anyone under 18 or under the age of majority required by local law. We do not knowingly collect personal data from children. If you believe a child has provided personal data to us, contact us at hello@instatv.io.

We use administrative, technical, and organizational safeguards designed to protect personal data, including access controls, logging, encryption where appropriate, secure authentication, vendor controls, and monitoring. No online service can guarantee absolute security.

You are responsible for using a strong password, protecting your devices, and keeping your account credentials confidential.
