Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and INSTATV TECHNOLOGIES LIMITED LIABILITY COMPANY, trading as InstaTV Technologies (“InstaTV”, “we”, “us”, or “our”). These Terms govern your access to and use of instatv.io, the InstaTV Studio, media generation tools, node-based workflows, challenge creation, challenge marketplace pages, comments, credits, and related services (collectively, the “Services”).

By creating an account, topping up credits, paying for a generation, generating content, publishing a challenge, posting comments, or otherwise using the Services, you agree to these Terms and our Privacy Policy, Refund Policy, and Cookie Policy.

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

You must be at least 18 years old and able to enter into a legally binding agreement to use the Services. If the law in your country requires a higher age, you may use the Services only if you meet that higher age requirement.

• You are responsible for keeping your login credentials secure.
• You must provide accurate account, billing, and contact information.
• You are responsible for all activity under your account, including uploads, prompts, generated outputs, purchases, comments, and challenge submissions.
• You must notify us promptly at hello@instatv.io if you believe your account has been compromised.

InstaTV provides a node-based AI production environment for video, image, and challenge workflows. Users can upload media files, create raster or vector images, generate video and image outputs, use canvas layers, effects, keyers, camera controls, AI models, and dynamic nodes, and package workflows as challenges.

Media generated in the Studio is private to your account unless you choose to submit or publish it. Challenge outputs and challenge pages may become public only when you request publication and our team approves the content and workflow for publication. We may reject, remove, hide, limit, or unpublish content or challenges at our discretion if they violate these Terms, our policies, applicable law, or platform safety standards.

AI systems may produce unexpected, inaccurate, offensive, incomplete, or similar outputs for different users. You are responsible for reviewing generated content before using, sharing, publishing, or relying on it.

InstaTV operates on a pay-as-you-go model. You may top up your account balance in USD and spend credits on eligible Studio generations, or you may pay directly for a specific challenge generation without adding money to your account balance.

• Credits are digital service credits. They are not deposits, bank accounts, stored-value cards, securities, or cash equivalents.
• No cash value. Credits may be used only within InstaTV and are not transferable, resellable, withdrawable, or redeemable for cash except where required by law.
• Usage pricing. Generation prices may vary by model, workflow, resolution, tool, challenge, compute usage, or other factors shown before purchase or generation.
• Credit expiry. Credits expire 12 months from purchase unless applicable law requires a longer period or prohibits expiry. We may provide notice before expiry where required by law.
• Taxes. Prices may be exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, duties, and charges.

Payment card details are processed by our payment provider or bank payment gateway. We do not intend to store full payment card numbers on our servers.

Refunds are governed by our Refund Policy. In summary, used credits and completed digital generations are generally non-refundable, except where required by law or where a technical failure, duplicate charge, or unauthorized charge is confirmed.

AI output quality can vary. Unless required by law, dissatisfaction with a generated output, prompt mistake, incorrect user input, or a change of mind does not by itself create a refund right after a generation has started or completed.

“User Content” means content you upload, submit, prompt, generate, edit, publish, comment, or otherwise provide through the Services, including images, videos, text, prompts, workflows, comments, and challenge materials.

As between you and InstaTV, you own your User Content and generated outputs to the extent permitted by applicable law and subject to third-party rights, model/provider terms, and these Terms. You are responsible for ensuring that you have the rights needed to upload input content and use outputs.

You grant InstaTV a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, modify, and use User Content as needed to provide, secure, operate, improve, and support the Services. If you submit content, workflows, or challenges for publication and they are approved, you also grant us the right to publicly display, distribute, promote, and allow other users to recreate or interact with the published challenge and related public outputs.

We do not claim ownership of private Studio generations that you do not publish. We may process private content for service operation, safety, moderation, debugging, abuse prevention, legal compliance, and support.

You must use the Services lawfully, responsibly, and in accordance with these Terms. You must not upload, generate, publish, share, or request content or activity that we determine is illegal, harmful, abusive, or unsafe.

• Adult sexual content, pornography, sexual exploitation, nudity involving minors, or sexualized content involving minors.
• Violence, self-harm encouragement, terrorist or extremist content, threats, harassment, bullying, or hateful content.
• Fraud, phishing, scams, impersonation, identity theft, deceptive deepfakes, or misleading political/public-interest content.
• Copyright, trademark, privacy, publicity, or other intellectual-property violations.
• Malware, attempts to bypass security, scraping, reverse engineering, model abuse, or platform interference.
• Illegal goods or services, regulated weapons, controlled substances, or instructions enabling criminal activity.
• Content or transactions involving sanctioned countries, sanctioned persons, restricted parties, or activity prohibited by anti-money laundering, counter-terrorist financing, export-control, or sanctions laws.

We may remove content, disable features, restrict generations, refuse publication, suspend or terminate accounts, preserve evidence, or report activity to authorities where we believe it is necessary or legally required.

Published challenges may include descriptions, creator information, previous generations, comments, workflow details, dynamic inputs, and related metadata. Users may comment or provide feedback on public challenge pages where the feature is available.

We may moderate public challenges and comments before or after publication. We may remove or edit visibility of content that violates these Terms, infringes rights, harms users, creates legal or payment risk, or is otherwise unsuitable for our marketplace.

The Services, platform design, code, branding, logo, user interface, node builder, tools, documentation, templates, and other InstaTV materials are owned by InstaTV or its licensors and are protected by intellectual-property and other laws.

You may not copy, sell, license, reverse engineer, scrape, interfere with, or create competing products from the Services except as expressly permitted by law or by written agreement with us.

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, specific results, output quality, legality of a particular use, model accuracy, marketplace performance, or commercial success from any generated content or challenge.

To the maximum extent permitted by law, InstaTV will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, business interruption, or claims arising from your content, prompts, outputs, publications, or use of third-party services.

To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to InstaTV for the specific transaction or Service giving rise to the claim during the three months before the event giving rise to liability.

We may suspend, restrict, or terminate your access to the Services if we believe you violated these Terms, created legal or security risk, engaged in fraud or abuse, violated payment or sanctions rules, or used the Services in a way that may harm InstaTV, users, creators, payment partners, or third parties.

You may stop using the Services at any time. Account deletion requests can be sent to hello@instatv.io. Some records may be retained where required for billing, tax, security, dispute, fraud-prevention, or legal compliance purposes.

These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Unless applicable consumer law requires otherwise, disputes will be subject to the jurisdiction of the competent courts located in Yerevan, Republic of Armenia.
